(1) Congress hereby declares that, in order to secure the rights of the Fourteenth Amendment to persons enrolled in United States-flagged schools where the predominant language of instruction was other than English, it is necessary to prohibit States from making the right to vote of such persons subject to the ability to read in English: write, understand or interpret. No person acting in accordance with the law may abstain or refuse to elect a person who is entitled to vote or otherwise entitled to vote under any of the provisions of Chapters 103 through 107 of this Title, or intentionally omits or refuses to compile, count and report such person`s vote. For an absentee ballot to be considered valid, absentee voters must have a witness — an adult U.S. citizen who can certify that the voter has completed their own ballot. The number of votes in an election is not official until it has been verified at the municipal level, reverified by the county, and certified by the state. If the elector`s choice can be determined only for some of the polling stations or questions on a ballot paper, the ballot paper shall be counted only for those polling stations or questions. A vote cannot be rejected because of a technical error that does not make it impossible to determine the voter`s intention. In determining intent, the principles set out in this section apply. L. 85-315, § 131, replaced “race, colour or a previous condition so as not to interfere with the right to vote” in the “Right to vote” section, designated the existing provisions as subsection (a), and added paragraphs. (b) to (e). No citizen of the United States who is otherwise entitled to vote by mail in a state or political subdivision in an election for President and Vice President may be denied the right to vote in such an election for the election of voters for President and Vice President or President and Vice President by reason of the requirement to register: which does not contain a provision for postal voting. The Congress notes that, through the use of various practices and procedures, citizens of linguistic minorities were effectively excluded from participation in the electoral process. Among other things, the denial of the right to vote to these minority citizens is directly linked to the unequal educational opportunities available to them, resulting in a high illiteracy rate and low voter turnout.
