Although we summarize judgments and thus give them a semblance of rationality, we do not make our own judgments about them. We take them for what they are and present them in published form. The law publisher set out to achieve its original goal by publishing Current Commercial Cases and Commercial Law Digest (later renamed Commercial Law Reports), both edited and written by attorney Mark Stranex. The first provides summaries of all judgments of commercial interest reported in South African legal reports. It is therefore intended to ensure full coverage of these judgments without giving the reader the task of having to read the full text of each judgment. The report is substantial, not cryptic, but rich in detail, and aims to provide a comprehensive understanding of the issues in dispute between the parties and the means by which the law was used to resolve the dispute. A person without legal training should understand how the law works by reading this publication. The driving force was then, and still is, the belief that law is not a donkey, but can be explained as a problem-solving activity that is consistent in itself and aims to resolve real-world disputes arising from the cutting off and pushing of commercial enterprises. Our job is to summarize a judgment clearly enough to explain the reasoning of the judge who rendered it and to explain it to the best of our ability. The reader can then decide whether the judge`s reasons are logical and reasonable, or whether he fails and makes the law look like a donkey. ASEP regularly works with ministries on how industry can help achieve national priorities and contribute to the formulation of relevant policies/legislation.
